Who are the persons eligible for guardianship according to the Mâliki’s Fiqh ? What is agreed on concerning the persons eligible for guardianship is the following: the mother who has the full right to nurture her children, if the mother is not eligible, the nurture moves back to the maternal grand mother. In case of the absence of the maternal grand mother, the maternal aunt has the right to nurture the youngster. If she is not able, the nurture moves to the paternal grand mother then it moves back to the relatives who have the right to inherit the youngster: the father and the paternal grand father. It is primordial to take into consideration the welfare of the child (either education or protection) when ascribing guardianship to those who are eligible for it.
