Marriage

 

1- Its definition: it is the contract that makes the marital relationship between man and woman lawful. This contract determines the rights and the duties of each of them.

2- Its legitimacy:

a) Marriage is God's law that is destinated to his creatures. «Glory be to Him, Who created the components of couples of every kind of what the ground caused to grow, and of themselves, (human beings) and of what you do not know» ]sūrat Yā-sīn, 36[. Every thing is created in pairs: human being, animal, plant and even the atom.

b) Marriage is a religious law. Allah ordered His prophets to marry. He says: «And marry those among you who are single, and the virtuous ones among your slaves, male or female, and if they are poor, God will provide means for them out of His bounty…» ]Sūrat An- Noor /the Light, 32[. The prophet -may peace be upon him- said: «Marriage is a part of my Sunna (religious law). Whoever turns away from my Sunna is not from amongst us». [Reported by El Boukhari and Muslim]. He also said: « O, Young men, if you are apt to marry, so marry.…». [Reported by El Boukhari and Muslim].
 

3- Its objectives:

a) Marriage is the pillar of the family.  

b) It is the lawful way to respond to human instinct.

c) To preserve mankind from extinction.

d) To achieve self tranquility and serenity. Allah the Great says: « And from His signs is that He created from yourselves your wives, that you find serenity with them, and He has set between you affection and mercy. Surely in this are signs for people who reflect ». ] Sūrat Ar- Rūm/The Romans, 21[.

e) To preserve the society from obscene morals.

f) To protect lineages from loss and dereliction.

g) To strengthen the bases of kindership and inheritance.

h) To strengthen the social relationships among the families.

I) To develop the sense of responsibility in both man and woman.

j) To develop the feeling of paternity and maternity.

4- Its stance: marriage may be:

a) Obligatory: marriage is an obligation for a person who is able to marry and afraid of falling in sin. So, marriage is the way of purity.

b) Desirable: For a young person who is able to marry and he is not afraid of falling in the sin.

c) Hateful: For a person who has bad intention behind marriage, as to marry a woman in order to harm her.
